General Terms & Conditions (GTC / AGB)

1. Scope of Application

1.1

These General Terms and Conditions (hereinafter «GTC») apply to all services and products offered by Arte Capelli da Capo GmbH (hereinafter Salon) to its clients, in particular hairdressing, coloring, and styling services as well as the sale of hair and care products.

1.2

By scheduling an appointment, entering the salon to receive a service, or purchasing a product, the client agrees to these GTC.

1.3

Deviating, conflicting, or supplementary conditions of the client do not become part of the contract unless the Salon expressly agrees to their validity in writing.

2. Appointment Scheduling

2.1

Appointments can be arranged by telephone, online, by e-mail, or in person at the salon.

2.2

The client is required to provide realistic and complete information about the desired service when scheduling an appointment (e.g., type of color treatment, hair length), so that the required time can be properly scheduled. Incomplete details may result in waiting times or rescheduling.

2.3

The Salon reserves the right to cancel or postpone appointments for good cause (e.g., staff illness, technical emergency). The client will be informed as quickly as possible.

3. Cancellation, Delays and No-Shows

3.1

Appointments can be canceled or rescheduled free of charge up to [24] hours before the scheduled appointment.

3.2

In the event of client delays of more than [30] minutes, the Salon reserves the right to shorten the service, postpone it to a new date, or cancel it without the client acquiring any claim for damages or reimbursement.

4. Prices and Payment Terms

4.1

The prices stated in the salon, on the website, or in the price list at the time the service is rendered apply in Swiss Francs (CHF), including statutory VAT where applicable.

4.2

The Salon reserves the right to adjust prices at any time. The price valid on the day the service is performed applies.

4.3

Payment is due immediately following the service unless otherwise agreed. The salon accepts the following means of payment: [Cash, EC/Credit Card, TWINT].

4.4

Additional services provided during the treatment at the client's request (e.g. additional products, treatment extension) will be billed additionally.

5. Vouchers

5.1

Vouchers are valid for [5 years] from the date of issue unless a different date is stated on the voucher. The statutory basis is the ten-year limitation period pursuant to Art. 127 CO, provided the voucher does not specify a shorter, explicitly agreed validity period.

5.2

Vouchers cannot be exchanged for cash. Cash payouts of remaining balances are excluded to the extent permitted by law.

5.3

In the event of voucher loss, there is no entitlement to a replacement.

6. Treatment, Consultation and Client Responsibility

6.1

The salon advises the client to the best of its knowledge and belief regarding the requested service (e.g., choice of color, haircut, product compatibility).

6.2

The client is obliged to inform the salon prior to the start of the treatment about known allergies, skin conditions, prior treatments (e.g., henna, other colorations) and pregnancy, insofar as this may be relevant to the treatment.

6.3

When using color or chemical products for the first time, the salon may recommend or require a tolerance patch test (allergy test). If the client declines such a test despite the recommendation, treatment is carried out at the client's own risk.

6.4

The Salon provides no guarantee for a specific treatment outcome (e.g., exact match of a desired color shade), in particular if this is influenced by the individual hair texture, previous treatments, or incomplete client information.

7. Complaints and Warranty

7.1

Complaints concerning the rendered service must be reported immediately, but no later than [3] days after the treatment, in writing or orally in the salon.

7.2

In the event of justified complaints, the salon will offer free touch-ups at its own discretion. A claim for price refund only exists if rectification is impossible or unreasonable for the client.

7.3

Otherwise, the statutory provisions of the Swiss Code of Obligations (CO) regarding contracts for work and services (Art. 394 et seq. or Art. 363 et seq. CO) apply, depending on the qualification of the specific service.

8. Liability

8.1

The salon is liable for damages caused culpably to the client by itself, its employees, or agents within the framework of statutory provisions (Art. 97 et seq. CO).

8.2

Liability for slight negligence is waived to the extent permitted by law. Liability for personal injury and for gross negligence and willful intent remains unaffected.

8.3

The salon assumes no liability for clothing, valuables, or other personal belongings brought by the client, except in cases of proven fault by the salon.

8.4

The salon is not liable for allergic or adverse reactions to used products if the client provided incomplete or incorrect information contrary to clause 6.2 et seq. or refused a recommended patch test.

9. Minor Clients

9.1

Clients under 16 years of age are served for non-chemical services (e.g. haircut, washing, blow-drying, styling).

9.2

Chemical treatments (namely coloring, bleaching, highlights, perm, and comparable chemical applications) are strictly not performed on clients under 16 years of age, even with parental consent.

10. Hygiene and Health Protection

10.1

The salon complies with applicable hygiene regulations. Clients with contagious diseases or skin infections in the treatment area are requested to notify the salon in advance; the salon reserves the right to decline or reschedule treatment in such cases.

11. Data Protection

11.1

The salon processes personal data of the client (e.g. contact details, appointment history, treatment notes) exclusively for contract execution and appointment management.

11.2

Processing is carried out in accordance with the provisions of the Swiss Federal Act on Data Protection (FADP / DSG).

11.3

The client has the right to information and rectification of their data in accordance with statutory regulations.

12. Amendments to the GTC

12.1

The salon reserves the right to modify these GTC at any time. The version valid at the time of appointment booking or service provision, which can be viewed in the salon and/or on the website, applies.

13. Final Provisions

13.1

Should individual provisions of these GTC be or become invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a valid provision coming as close as possible to the economic purpose.

13.2

Swiss law applies exclusively, to the exclusion of conflict-of-law provisions and the UN Convention on Contracts for the International Sale of Goods (CISG).

13.3

The place of jurisdiction for all disputes arising from or in connection with these GTC or the contractual relationship is, to the extent permitted by law, the registered seat of the salon in [Thun]. Mandatory statutory jurisdictions (e.g. at the consumer's domicile pursuant to Art. 32 CPC) remain reserved.
